« Il n’est pas toujours évident de savoir si l’employeur a respecté le délai minimum de 5 jours ouvrables entre la convocation et l’entretien préalable au licenciement. Cela s’explique notamment par des questionnements sur le point de départ pour calculer ce délai.
Nouvelle précision de la Cour de cassation en la matière. C’est bien à compter du lendemain de la première présentation de la lettre recommandée de convocation à l’entretien que débute le délai de 5 jours ouvrables, peu importe que la salariée soit allée tardivement récupérer sa lettre.
